End-User License Agreement (EULA) This End-User License Agreement ("EULA") is a legal agreement between you ("User") and Daniel Weber ("We", "Company") for the use of Gremlinq.Extensions.GroovyScripts ("Software"). By installing, copying, distributing, or otherwise using the Software, you agree to be bound by the terms of this EULA. Copyright Notice © 2024 Daniel Weber. All rights reserved. Gremlinq.Extensions.GroovyScripts and any accompanying materials are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. 1. License Grant The Company grants you a non-exclusive, non-transferable, limited license to: a. Use the Software in accordance with the terms of this EULA. b. Distribute the Software as part of your application, provided that your application adds significant value and functionality beyond that provided by the Software alone. 2. License Key a. You will be provided with a license key ("License Key"), which is a token that allows you to download the Software from the NuGet server. b. The License Key is bound to a limited number of development machines, depending on the type of subscription you have purchased. The specifics of the number of development machines covered will be outlined in your subscription plan. c. The License Key may be used on an unlimited number of build servers. For the purposes of this EULA, build servers are defined as machines that are exclusively used for automated building, testing, and deployment of applications, and are not used by developers to actively develop applications that use the Software. d. You must take appropriate measures to protect the License Key and ensure it is not leaked into the public domain. Specifically, you must not submit the License Key to any public source control systems, including but not limited to GitHub, GitLab, Azure DevOps, and similar platforms. The License Key should be stored securely and only accessible by authorized personnel. e. If a leaked License Key surfaces in public, we may revoke the License Key and send a regenerated License Key to you. f. You must not distribute, sell, or transfer the License Key to any third party. The License Key is intended solely for your use to access and use the Software in accordance with this EULA. 3. Distribution Rights a. You may distribute the Software only as part of your own application. b. Your application must not compete directly with the Software. c. You must ensure that the Software, when distributed, is accompanied by this EULA and that end-users agree to be bound by its terms. d. You may not modify, adapt, or create derivative works based on the Software, except as necessary to integrate it into your application. 4. Restrictions a. You may not reverse engineer, decompile, or disassemble the Software. b. You may not distribute the Software on a standalone basis. c. You may not use the Software for any unlawful purpose. 5. Ownership The Software is licensed, not sold. The Company retains all right, title, and interest in and to the Software, including all intellectual property rights. 6. Limitations of Liability In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software. 7. Warranties and Disclaimers The Software is provided "as is" without warranty of any kind. The Company disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. 8. Termination This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Company if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the Software and destroy all copies of the Software. 9. Governing Law This EULA shall be governed by and construed in accordance with the laws of Germany. Any disputes arising out of or relating to this EULA shall be resolved in the courts of Germany. 10. Updates and Maintenance The Company may provide updates, upgrades, or maintenance for the Software at its discretion. Such updates, upgrades, or maintenance may be subject to additional terms and conditions. 11. Entire Agreement This EULA constitutes the entire agreement between you and the Company with respect to the Software and supersedes all prior or contemporaneous understandings regarding such subject matter.
